Access Copyright Licence Expiry and What You Need to Do

Toronto Metropolitan University’s agreement with Access Copyright was in place until midnight Dec 31st, 2015. After that our licence with Access Copyright was not renewed. In 2013 Toronto Metropolitan University adopted the Toronto Metropolitan University Fair Dealing Guideline. This guideline allows you to post up to 10% or one chapter of a work (for example from a print book) to a password protected Learning Management Systems like D2L for the purpose of education. Material that is 10% or one chapter of a work (whichever is larger) can be delivered to your students using our fair dealing guideline as a handout or posted in D2L.

Review your Content

You will need to review the copyrighted content you make available to your students, if you have not already done so. The Access Copyright Model licence that Toronto Metropolitan University signed requires that, upon expiry, the University “shall immediately use reasonable efforts to (i) prevent access to Digital Copies of [Access Copyright] Repertoire Works made under this agreement and stored on a Secure Network under its control, and (ii) inform all Authorized Persons [faculty, students, etc.] that the [University] no longer has a license from Access Copyright for the use of Repertoire Works”.

If you use the One Stop Course Reading Service – E-Reserve or the Campus Store – the licences on your content will be checked by staff. Please send your requests into reserve@torontomu.ca ASAP or send in your coursepack content ASAP to the Campus Store.

If you use the Do It Yourself Copyright option and have uploaded full text copyrighted content by yourself to D2L or other university networks you will need to review that content and check if library licence terms allow the use OR that fair dealing guideline amounts are abided by. If you want to use more than 10% or one chapter of a work (whichever is larger), please send your permission request to reserve@torontomu.ca and the library will try to get a licence to use the work in your course.

Full text articles from Library databases. Instructors should check if electronic journal articles or e-books obtained from TMU subscription databases have licences that allow material to be posted as full-text articles or chapters to an LMS. See Instructions for How to Check Library Licenced material. Library staff can assist with this checking this and send you persistent links that you can supply to your students instead.
